This issue is particularly concerning given President Trump's warnings about the threat to the 'heart' of democracy posed by digital election interference. While New Jersey's error is notable, it's not an isolated case. The lack of a national standard for identifying and reporting errors makes it challenging to assess the true scope of the problem. Jason Snead, from the Honest Elections Project, emphasizes the vulnerability, citing recent discoveries of noncitizens on voter rolls in multiple states. The issue is further complicated by the absence of a uniform federal requirement for states to disclose their findings, leading to inconsistent enforcement and reporting methods. This inconsistency is particularly problematic in blue states, where policies like automatic voter registration and driver's licenses for illegal aliens may contribute to the problem. The Department of Homeland Security (DHS) has also found significant numbers of noncitizens registered to vote in several states, including New Jersey, California, Nevada, and Pennsylvania, raising concerns about the integrity of elections. The National Voter Registration Act (NVRA) is silent on the issue of noncitizens on voter rolls, leaving states with ambiguity regarding their obligations to audit and report such errors. States that have conducted reviews have reported concerning findings, with noncitizens registered to vote in Louisiana, Iowa, Michigan, Ohio, and Illinois. The issue extends beyond voter rolls, with cases of noncitizens casting ballots in federal elections, as evidenced by the DOJ's acknowledgment of illegal voting by a Ghanaian national in Maryland and a resident alien in Texas. The lack of proof of citizenship requirements in some states further exacerbates the problem. The DOJ's Civil Rights Division has taken legal action against states, seeking to compel the production of voter registration lists and reminding them of their obligations to clean voter rolls. However, the effectiveness of these measures is still a matter of debate, and the desire to fix the issue remains a question of political will.
